Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the services, including our application and services (“Benafica”). Benafica is a service of LeClair Group. Your access to, and use of our services are conditioned on your acceptance of and compliance of these terms. By accessing or using the Services you agree to be bound by these terms.
1. Basic Terms
You are responsible for your use of the Services. Provided that you agree with these Terms, the content that is displayed will not be able to be viewed by other members. You may use the Services if you are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction.
The Services that Benafica provides are always evolving and the form and nature of the Services that Benafica provides may change from time to time. We will provide notice to you via email or within the application to notify you of any change.
It is possible that we may need to disclose personal information, or information about your policies when required by law, subpoena, or other legal process in the United States. We will notify members about legal demands for their personal information when appropriate in our judgment, unless prohibited by law or court order when the request is an emergency.
2. Privacy
Any information that you provide to Benafica is subject to our Privacy Policy, which governs our collection and use of your information. We collect information when you use our services to offer you a personalized and relevant experience, including viewing your policies. We keep your information for as long as your policy is active or as needed. For example, we may keep certain information even after you close your account or policy if it is necessary to comply with our legal obligations, meet regulatory requirements, resolve issues and to prevent fraud, or enforce this agreement. Our Customer Service may retain information for as long as is necessary to provide support-related answers to members of Benafica.
3. Passwords
You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. Benafica will not be liable and disclaims responsibility for any loss or damage arising from your failure to comply with the above.
4. Content on the Services
The personal information that you provide to us will enable the creation of your personal benefit account. By providing personal information to us when you create your account, you are voluntarily accepting the terms and conditions and freely accepting and agreeing to our processing of your personal information in ways set out by the Privacy Policy.
5. Your license to Use the Services
Benafica gives you a personal non-exclusive license to use the software that is provided to you by Benafica as part of the Services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Benafica, in the matter permitted by these terms.
6. Benafica Rights
All right, title, and interest in and to the services are and will remain the exclusive property of LeClair Group and Benafica and its licensors. The Services are protected by copyright, trademark, and other laws in the United States. Nothing in the Terms gives you a right to use the Benafica name or any of the Benafica trademarks, logos, domain names and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding Benafica, or the Services is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit without an obligation to you.
7. Restrictions on Content and Use of the Services
We reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or government request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of Benafica and its users.
8. Ending These Terms
The Terms will continue to apply until terminated by either you or LeClair Group as follows. You may end your legal agreement with Benafica at any time for any reason by contacting LeClair Group.
9. General Terms
These Terms and our Privacy Policy are the entire and exclusive agreement between Benafica and you regarding the Services. We may revise these Terms from time to time, the most current version will always be at benafica.com/tos. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.
